End User License Agreement (EULA) for Time Bank

IMPORTANT: CAREFULLY READ THIS END USER LICENSE AGREEMENT («EULA») BEFORE INSTALLING OR USING THE «TIME BANK» ADD-ON (THE «SOFTWARE»). BY INSTALLING, COPYING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL, COPY, OR USE THE SOFTWARE.

License

Inlogiq Software Quality S.L. («Developer») grants you a limited, non-exclusive, non-transferable, revocable, and free license to install and use the Software, solely in connection with your use in the Atlassian Marketplace («Atlassian Marketplace»). You agree not to tamper with, sublicense, sell, rent, lease, lend, distribute, or transfer the Software or any part thereof to third parties.

Intellectual Property

The Software and all related intellectual property rights, including but not limited to copyrights, trademarks, and patents, are the property of the Developer and are protected by applicable intellectual property laws. You do not acquire any ownership rights in the Software under this EULA, and all rights not expressly granted are reserved to the Developer.

GDPR Compliance and Data Protection

The Developer warrants that the Software complies with the European Union’s General Data Protection Regulation (GDPR) and does not collect, store, process, or transfer users’ personal data. By using the Software, you agree to comply with all applicable laws and regulations regarding data protection and privacy.

Updates and Support

The Developer may, at its discretion, provide updates, enhancements, or bug fixes for the Software, but has no obligation to do so. The Developer does not provide technical support or guarantee the compatibility of the Software with future versions of the Atlassian Marketplace or other Atlassian products.

Warranty Disclaimer and Limitation of Liability

The Software is provided «as is» without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the Developer be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) arising out of or in connection with the use or inability to use the Software, even if the Developer has been advised of the possibility of such damages.

Termination

This EULA becomes effective from the moment you install or use the Software and remains in effect until terminated. You may terminate this EULA at any time by ceasing to use the Software and deleting all copies of the Software from your devices. The Developer may terminate this EULA at any time, with or without cause, by notifying you or disabling the Software.

Applicable Law

This EULA shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of laws provisions. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in Spain.

Entire Agreement

This EULA constitutes the entire agreement between you and the Developer concerning the Software and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral, concerning the Software. No amendment or modification of this EULA shall be binding unless in writing and signed by the Developer.

IMPORTANTE: LEA DETENIDAMENTE ESTE ACUERDO DE LICENCIA DE USUARIO FINAL («EULA») ANTES DE INSTALAR O UTILIZAR EL COMPLEMENTO «TIME BANK» (EL «SOFTWARE»). AL INSTALAR, COPIAR O UTILIZAR EL SOFTWARE, USTED ACEPTA ESTAR SUJETO A LOS TÉRMINOS DE ESTE CLUF. SI NO ESTÁ DE ACUERDO CON LOS TÉRMINOS DE ESTE CLUF, NO INSTALE, COPIE NI UTILICE EL SOFTWARE.

Licencia

Inlogiq Software Quality S.L. («Desarrollador»)  le otorga una licencia limitada, no exclusiva, intransferible, revocable y gratuita  para instalar y utilizar  el  Software, únicamente  en relación con su uso en el  Atlassian Marketplace  («Atlassian Marketplace»).  Usted acepta   no manipular, sublicenciar, vender, alquilar  , arrendar, prestar, distribuir  o  transferir el Software o cualquier parte del mismo a terceros.

Propiedad Intelectual

El Software  y  todos los derechos   de propiedad   intelectual relacionados con  él, incluidos, entre otros,  derechos de autor, marcas comerciales y patentes  , son propiedad  del Desarrollador y están protegidos   por  Leyes de  propiedad intelectual aplicables.   Usted  no  adquiere ningún derecho de propiedad sobre el Software en virtud de  este EULA, y todos los derechos no otorgados expresamente están reservados al  Desarrollador.

Cumplimiento del RGPD y protección de datos

El Desarrollador garantiza que el  Software cumple con el Reglamento General de Protección de Datos  (RGPD)  de  la Unión Europea y  no recopila, almacena, procesa ni transfiere los datos personales de los usuarios. Al utilizar el Software, usted acepta  cumplir con todas las leyes y regulaciones aplicables en relación con la protección de datos  y la privacidad.

Actualizaciones y soporte

El Desarrollador puede, a su discreción, proporcionar actualizaciones, mejoras o correcciones de  errores  para el Software, pero no   tiene ninguna obligación de hacerlo.  El Desarrollador  no proporciona asistencia técnica ni garantiza la compatibilidad del  Software con futuras versiones de Atlassian  Marketplace u otros productos de  Atlassian.

Exclusión de garantías y limitación de responsabilidad

El Software se proporciona «tal cual» sin garantías de ningún tipo, expresas o implícitas, incluidas, entre otras, las garantías de comerciabilidad, idoneidad para una determinada  finalidad, y no infracción. En ningún caso el Desarrollador será responsable de   ningún daño directo, indirecto, incidental, especial, ejemplar o consecuente (incluidos, entre otros,   adquisición de bienes o servicios sustitutivos;  pérdida de uso, datos o beneficios;  o  interrupción del  negocio)  que surja  de, o  en relación con, el  uso o la imposibilidad de  usar  el  Software, incluso si el Desarrollador ha sido advertido de   la posibilidad de tales daños.

Terminación

Este EULA  entrará en vigor  desde el  momento en que  instale o utilice el Software y permanecerá  en vigor hasta su finalización.   Puede  rescindir este EULA en cualquier momento dejando   de  usar el Software y eliminando todas las copias  del Software de sus dispositivos.   El Desarrollador puede rescindir este EULA en cualquier momento, con o sin causa,      notificándole o deshabilitando el Software.

Legislación aplicable

Este EULA  se regirá  e   interpretará de acuerdo  con  las leyes de  España, sin tener en cuenta sus disposiciones de  conflicto de leyes.   Cualquier disputa que surja de  o en relación con este EULA  se someterá a la jurisdicción exclusiva  de  los tribunales ubicados en España.

Acuerdo completo

Este EULA constituye el  acuerdo completo entre usted y   el Desarrollador con respecto al Software y   reemplaza  todos los acuerdos, entendimientos o representaciones  anteriores o contemporáneos, ya sean escritos u oral, en relación con  el Software. Ninguna enmienda o modificación de este EULA  será vinculante a menos que sea por escrito y esté firmada por el Desarrollador.
